Bevin Refuses to let Supreme Court Decide Consumer Protection Case

Bevin Administration Drops Case

Matt Bevin2.jpg

Governor Bevin's new insurance commissioner has decided to drop the state's defense of a 2012 consumer protection law designed to help life insurance beneficiaries.  Apparently, the Governor has decided that his constitutional role is not limited to enforcing the laws of this Commonwealth, but also to interpret them as well.  By causing the state to drop its defense of the law before the Supreme Court has had the opportunity to review it, Gov. Bevin has usurped the province of the Courts.

This is certainly disappointing given Gov. Bevin's claim to be a "constitutional conservative."  In case anyone has forgotten, under our constitutional system the Legislature enacts laws, the Courts interpret them, and the Executive enforces them.  These are the "checks and balances" in our government, and are designed so that one branch does not become too powerful.

Do the right thing and fight for the people Gov. Bevin and let our Supreme Court interpret the law.
